Terms of Service

These Terms of Service govern access to websites, applications, platforms, and related services provided by AYUSHI HEALTHSYNC TECHNOLOGIES LLP, operating as Ayushi HealthSync, including MedChaaya. By using a service, you agree to these terms and any product-specific, order-form, or customer terms that apply. If you use a service for an organization, you confirm that you are authorized to bind that organization.

Our products provide technology for healthcare workflows. Ayushi HealthSync does not replace a qualified healthcare professional and does not independently diagnose, prescribe, or guarantee a clinical outcome. Do not use the services for a medical emergency. Contact local emergency services or an appropriate healthcare provider.

You must provide accurate information, keep credentials confidential, use only your authorized role, and promptly report suspected unauthorized access. Organizations are responsible for user provisioning, permissions, and activity under accounts they manage. We may require identity, professional, or facility verification for certain functions.

You may use the services only for lawful, authorized healthcare and business purposes. Healthcare organizations and professionals are responsible for clinical decisions, professional obligations, notices, consents, and authority to collect, access, upload, or share patient and organizational data. Data use must comply with the Digital Personal Data Protection Act, 2023, applicable rules, and other relevant Indian laws.

You must not:

• access records, accounts, or systems without authorization;
• upload unlawful, misleading, malicious, or infringing content;
• interfere with security, availability, monitoring, or technical safeguards;
• reverse engineer or copy protected elements except where law expressly permits;
• use automated methods that create unreasonable load or bypass access controls; or
• use the services to discriminate, cause harm, or make unlawful clinical or insurance decisions.

Our handling of personal data is described in our Privacy Policy. Enterprise deployments may also be governed by a data-processing agreement, security schedule, retention terms, and documented customer instructions. Each party must meet the data-protection duties that apply to its role.

Features that interact with ABDM, ABHA, healthcare providers, payment services, communications providers, maps, or other third parties may be subject to separate terms, availability, consent, and verification requirements. References to ABDM or ABHA do not by themselves mean that a product is certified, approved, or endorsed by the National Health Authority or the Government of India.

Ayushi HealthSync and its licensors own the services, software, design, documentation, trademarks, and related intellectual property. Subject to applicable terms and payment, users receive a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose. Users retain rights in content they lawfully provide.

Commercial fees, taxes, payment terms, service levels, support, and deployment scope are set out in the applicable order or contract. We may maintain, improve, or change services and may temporarily restrict access for security, maintenance, legal, or operational reasons. Beta or preview features may change and may not be suitable for production use.

To the extent permitted by law, services are provided subject to the warranties expressly stated in the applicable contract. We do not warrant uninterrupted availability, error-free operation, or that technology-generated information is complete or suitable for an independent clinical decision. Users must apply professional judgment and verify material healthcare information.

Liability will be determined under the applicable customer agreement and Indian law. To the maximum extent legally permitted, Ayushi HealthSync will not be liable for indirect, incidental, special, punitive, or consequential loss arising from unauthorized use, third-party services, connectivity failures, or decisions made without appropriate professional review. Nothing excludes liability that cannot lawfully be excluded.

We may suspend or terminate access where reasonably necessary to address a material breach, security risk, unlawful activity, non-payment, or legal requirement. On termination, rights to use the service end. Data return, retention, and deletion remain subject to applicable law and the relevant customer agreement.

These terms are governed by the laws of India. Subject to any arbitration or dispute process in an applicable customer agreement, courts with jurisdiction in Bhopal, Madhya Pradesh, will have jurisdiction. Mandatory consumer rights and statutory remedies remain unaffected.
